Terms of Service

1. Acceptance of Terms

By accessing or using FuelFlow Dispatch ("the Service"), operated by Interactive Informatics ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including company administrators, supervisors, dispatchers, and drivers.

2. Description of Service

FuelFlow Dispatch is a cloud-based fleet fuel management platform that enables organizations to track fuel consumption, manage vehicle and equipment assets, assign trips, monitor expenses, generate reports, and analyze operational efficiency. Access to the Service is provided on a subscription basis.

3. Account Registration

To use the Service, you must be invited by a company administrator or register through an authorized channel. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. User Roles and Permissions

The Service supports multiple role levels (Admin, Supervisor, Dispatcher, Driver). Each role carries different permissions and responsibilities. Administrators are responsible for managing users within their organization and ensuring compliance with these Terms by all users they onboard. You agree not to attempt to access features or data beyond the permissions assigned to your role.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You must not:

• Enter false, misleading, or fraudulent data into the platform
• Attempt to gain unauthorized access to any part of the Service or other users' accounts
• Use the Service to transmit malware, spam, or any harmful content
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Use the Service in any manner that could damage, disable, or impair its operation
• Resell, sublicense, or commercially exploit the Service without our written consent

6. Data Ownership

All fleet operational data you enter into the Service (vehicle records, fuel logs, trip data, expenses, etc.) remains your property. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing and improving the Service. We do not claim ownership of your data.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance, technical issues, or circumstances beyond our control may result in temporary downtime. We will endeavor to provide advance notice of planned maintenance where possible.

8. Intellectual Property

The Service, including its software, design, logos, trademarks, and content (excluding your data), is the exclusive property of Interactive Informatics and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or other intellectual property without our prior written consent.

9. Confidentiality

The Service may contain features that allow storage and access to sensitive operational data. You agree to maintain the confidentiality of any proprietary information accessed through the Service and to implement reasonable measures to prevent unauthorized disclosure.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Interactive Informatics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of data, loss of profits, or business interruption, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or continuously available.

12. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms. You may also terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Data retention after termination is governed by our Privacy Policy.

13. Changes to These Terms

We may modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date and, where appropriate, by sending an email notification. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Tanzania. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Dar es Salaam, Tanzania.
